1. Acceptance of Terms
By accessing or using PrayerMap ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Age Requirements
You must be at least 18 years of age to use PrayerMap. This app is rated 17+ and contains user-generated content that may include mature themes such as discussions of illness, death, grief, addiction, mental health challenges, and other serious life situations. By using PrayerMap, you represent and warrant that you are at least 18 years old. If you are under 18, you are not permitted to use this Service.
3. Description of Service
PrayerMap is a non-profit ministry platform that enables users to share prayer requests and support one another through a location-based map interface. The Service includes push notifications to keep you informed of prayer responses and community activity, and automated content moderation to maintain a safe environment. The Service is provided free of charge as a ministry to connect people through prayer.
4. License Grant
Subject to your compliance with these Terms, PrayerMap grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service on compatible devices that you own or control, solely for your personal, non-commercial use.
This license does NOT include and you may NOT:
- Distribute, sublicense, lease, rent, loan, or sell the Service
- Modify, adapt, translate, or create derivative works of the Service
- Use the Service for any commercial purpose without written authorization
- Reverse engineer, decompile, disassemble, or attempt to derive source code
- Remove or alter any copyright, trademark, or proprietary notices
5. User Accounts
To use certain features of PrayerMap, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
6. User Content
You retain ownership of content you submit to PrayerMap ("User Content"). By posting content, you grant PrayerMap a non-exclusive, royalty-free, worldwide, sublicensable license to host, store, reproduce, display, and distribute your content within the Service.
You agree not to post content that:
- Is unlawful, harmful, threatening, abusive, or harassing
- Infringes on intellectual property rights
- Contains spam, advertising, or solicitations
- Impersonates others or misrepresents your identity
- Violates the privacy of others
By submitting User Content, you represent that you own all rights or have obtained necessary permissions, and that your content does not infringe any third-party rights.
7. Community Guidelines
PrayerMap is a faith-based community. We expect all users to treat others with respect and kindness. Content that promotes hatred, discrimination, or violence is not permitted.
8. Content Moderation
To maintain a safe community, all content submitted to PrayerMap is subject to automated screening and human review. We use TheHive.ai for automated content moderation and maintain a dedicated moderation team. Content that violates our guidelines may be removed, and accounts that repeatedly violate guidelines may be suspended or terminated.
9. Push Notifications
PrayerMap may send push notifications to your device to inform you of prayer responses, messages, and community activity. You can manage or disable push notifications through your device settings at any time.
10. Privacy
Your use of PrayerMap is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.
11. Intellectual Property
The PrayerMap name, logo, "Prayer. Shared.", "Living Map," and all related trademarks, service marks, and trade names are the property of PrayerMap. The Service, including its software, algorithms, user interface, graphics, designs, and the prayer connection visualization technology are owned exclusively by PrayerMap and protected by United States and international intellectual property laws. You may not use these marks or replicate proprietary features without our prior written permission.
12. DMCA Copyright Policy
PrayerMap respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on PrayerMap infringes your copyright, send a written notice to contact@prayermap.net containing:
- Physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work
- Identification of the allegedly infringing material and its location
- Your contact information
- Statement of good faith belief that the use is unauthorized
- Statement under penalty of perjury that the notification is accurate
PrayerMap will terminate accounts of users who are determined to be repeat infringers.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that location data will be accurate.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRAYERMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICE.
IN NO EVENT SHALL PRAYERMAP'S TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO PRAYERMAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).
You acknowledge that PrayerMap is a free, non-profit service and that these limitations reflect a reasonable allocation of risk essential to this agreement.
15. Indemnification
You agree to indemnify, defend, and hold harmless PrayerMap, its officers, directors, employees, volunteers, agents, and service providers from any claims, liabilities, damages, losses, costs, or fees (including reasonable attorneys' fees) arising from:
- Your use of the Service in violation of these Terms
- User Content you submit, including claims of infringement, privacy violations, or defamation
- Your violation of any law or third-party rights
- Unauthorized use of your account due to failure to secure credentials
16. Dispute Resolution and Arbitration
16.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at contact@prayermap.net to attempt informal resolution. We will respond within thirty (30) days.
16.2 Binding Arbitration
If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in your county of residence or via videoconference. PrayerMap pays AAA fees for claims under $10,000 unless frivolous.
16.3 Exceptions
The following may be brought in court: intellectual property claims, claims seeking injunctive relief, small claims court matters, and sexual assault or harassment claims.
16.4 Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY, NOT AS PART OF ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
16.5 Opt-Out Right
You may opt out of arbitration within thirty (30) days of accepting these Terms by emailing contact@prayermap.net with your name, email, and clear opt-out statement.
16.6 Jury Trial Waiver
TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL.
16.7 Time Limit
Claims must be filed within one (1) year of accrual or be permanently barred.
17. Export Controls
The Service is subject to U.S. export control laws. You may not access the Service if you are located in or a resident of Belarus, Cuba, Iran, North Korea, Russia, or sanctioned regions of Ukraine (Crimea, Donetsk, Luhansk), or if you are listed on any U.S. government prohibited parties list.
By using the Service, you represent that you are not located in a sanctioned country and are not on any prohibited parties list.
18. Termination
We may terminate or suspend your account at any time for violation of these Terms, illegal activity, harm to other users, repeated intellectual property infringement, security threats, or service abuse. You may delete your account at any time through Profile > Settings > Delete Account.
Upon termination, your license to use the Service is revoked. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.
19. Governing Law
These Terms are governed by Texas law without regard to conflict of law principles.
20. Changes to Terms
We may update these Terms of Service from time to time by posting updated terms. Continued use constitutes acceptance. We will notify you of significant changes through the app or by email.
